If you or a loved one has been injured in a car accident caused by a speeding driver, contact the experienced and compassionate West Palm Beach speeding accident lawyers at Schuler, Weisser, Zoeller, Overbeck & Baxter P.A. today. Speed limits are posted in order to protect motorists, pedestrians, and cyclists on the road from serious accidents. Unfortunately, drivers sometimes fail to take these limits seriously for a variety of reasons, whether they are late for an appointment or driving under the influence. Although driving above the posted limit may save you a couple of extra minutes, these minutes are often never worth the increased risk of harming yourself and others. When a victim is injured in a car accident caused by another driver’s speeding, the driver may have been negligent or reckless, and the victim may be entitled to compensation for expenses such as medical bills, lost wages, damaged property, and pain and suffering.

Why Do I Need a Lawyer?
The law and legal process concerning car accidents can be complex and frustrating. During a time when you should be focused on healing, legalities are not something you should have to worry about. An attorney can help because they:
- Know the laws and can help evaluate the strength of your case
- Can identify what possible legal causes of action you may have against those who harmed you
- Can identify parties who may be legally liable for your injuries
- Speak with other attorneys, insurance representatives, and other professionals
Further, many attorneys consult with medical experts, accountants, and other experts to determine the severity of your injuries and calculate an appropriate amount of compensation for your injuries and required care. It is important to remember that an attorney is there to represent you, ensure your rights are not violated, and protect you against being pressured into settling for a lesser amount than what you may rightfully deserve.

Common Injuries Caused by Speeding Accidents
At Schuler, Weisser, Zoeller, Overbeck & Baxter P.A., we handle a wide range of personal injury lawsuits, including car accidents resulting from speeding. When a driver causes an accident because of speeding, they may have acted negligently or recklessly and may be liable to others for any damages they cause. Speeding accidents have the ability to cause major injuries, and in some cases even death.
According to the National Highway Traffic Safety Administration (NHTSA), speeding is a contributing factor in approximately one-third of all fatal car accidents. When an accident occurs at high speeds, the amount of energy released during collision increases exponentially. The force of collision can cause life-altering injuries such as the following:
- Spinal and neck trauma (sometimes resulting in paralysis)
- Head injuries
- Broken limbs
- Damage to internal organs
- Severe lacerations and bruising
These injuries can rack up steep medical costs, and may prevent the victim from leading a normal life. At Schuler, Weisser, Zoeller, Overbeck & Baxter P.A., we strongly believe that victims of speeding accidents shouldn’t have to deal with these repercussions alone.
Unfortunately, car accidents that result from speeding are often caused by another party’s reckless or negligent behavior. Negligence occurs when a person with a reasonable duty to prevent foreseeable harm to others fails in their duty, thereby causing damage to another. It is well established that drivers have a duty to drive in a reasonable manner, including obeying laws, so as not to cause harm to others. Speeding is not obeying the law, and a driver who causes harm to another while speeding may be liable to the victims for their resulting injuries.
Reckless driving occurs when an individual knows about and ignores a risk that can cause harm to others. It is well established that speeding causes accidents. Further, accidents that occur at higher rates of speed can cause more serious injuries and a greater number of fatalities. Drivers who disobey laws and speed, thereby ignoring the fact that their behavior poses a danger to others, is reckless. A driver who causes an accident due to recklessness or negligence may be legally responsible for compensating victims that were injured as a result of their behavior.
Frequently Asked Questions About Speeding Accidents
The Florida Department of Transportation (FDOT) is responsible for setting the speed limits on state highways, but certain maximums apply to certain types of roadways throughout the state. The maximum speed limit on interstates is 70 miles per hour. On a four-lane divided highway outside an urban area (with a population of 5,000 or more), the maximum speed limit is 65 miles per hour. On all other state highways, the maximum speed limit is 60 miles per hour.
The speed limit for roads on residential and/or business districts within city municipalities can be no higher than 60 miles per hour.
The FDOT says that a driver’s speed can be influenced by a number of factors. These can include the speed they have traveled at for the previous five or 10 miles, the time of day, the purpose of the trip, pavement type and condition, and ambient light.
Other factors, such as shoulder width and condition, the familiarity of the driver with the road, pavement roughness, the condition of vehicle, adjacent land use and development, and the urgency of trip can also affect the driver’s speed.
Finally, additional factors that can impact a driver’s speed are traffic volume, the driver’s emotional state, the lane width, the driver’s experience, the speed of other drivers, the weather, and the presence of law enforcement.
In Florida, you have four years from the date of a car accident to file a legal action. When a person is killed in a speeding accident, a family has only two years to file a wrongful death claim, but the limitations period begins on the date of a person’s death rather than on the date of an accident.
When a speeding accident victim is incapacitated or a minor, the statute of limitations can be delayed for up to seven years from the date of the accident or until the victim is capable of filing a lawsuit.
Speeding Accident Statistics
Speeding and aggressive driving often go hand-in-hand, so Florida reporting agencies classify them together as a single cause of accidents. In 2016, speeding and aggressive driving in Florida resulted in 426 fatal accidents, 1,350 incapacitating accidents, 3,718 non-incapacitating accidents, 6,536 possible injury accidents, and 61,375 accidents with no injuries.
What is more alarming, however, is a July 2018 article in the South Florida Sun Sentinel that shows fewer tickets for speeding are being issued in South Florida, while the rate of accidents from speeding and other types of driver errors are increasing.
2017 Statistics from the Florida Department of Highway Safety and Motor Vehicles tell the story of the changes from 2012 to 2017. In Palm Beach County, for example, the number of citations issued fell by 67,000 while the number of vehicle accidents (and fatalities, at 624) rose by more than 57 percent. The number of speeding tickets issued in Miami-Dade County, Broward County, and Palm Beach County fell respectively by 41 percent, 31 percent, and 38 percent.
Law enforcement cites staffing shortages, driver reeducation classes, and an increase in verbal or written warnings as the reasons for less traffic tickets being issued.
